The new Coronavirus (COVID-19) presents an unprecedented workplace challenge to transportation construction employers and workers as they struggle to comply with new congressional legislation, protect their employees, and continue working on projects.
“The over-arching goal for any employer should be ‘safety first’ for employees,” said Phillip Russell of Ogletree Deakins, a Tampa, Fla. law firm specializing in workplace issues for construction companies.
During a special March 20 ARTBA webinar, Russell and his colleague, Dee Anna Hays, addressed several key issues facing employers in these unprecedented times. These include:
- prevention education
- workplace safety and health (OSHA)
- leave of absence
- work hour and shift changes
- remote work, furloughs
- wage and hour issues
- potential reductions in force and the applicability of the Worker Adjustment and Retraining Notification (WARN) Act.
