The Federal Motor Carrier Safety Administration (FMCSA) Aug. 23 published an advanced notice of proposed rulemaking for different elements of the federal hours of service (HOS) regulations.

The agency will take input on these four areas:

  • short-haul HOS limit;
  • HOS exemption for adverse driving conditions;
  • 30-minute rest break provision; and
  • sleeper birth rule to allow drivers to split their required time in a sleeper birth.

ARTBA believes the HOS rules, which are meant to regulate long-haul truckers, are incorrectly applied to transportation construction. ARTBA has repeatedly called for a re-examination of the HOS rules and welcomes the move by FMCSA, which comes in response to President Trump’s January 2017 executive order on “Reducing Regulation and Controlling Regulatory Costs.”

The comment period closes Oct. 10.
