ARTBA Vice President of Regulatory Affairs Nick Goldstein voiced the association’s views on repealing and rewriting the “waters of the United States” (WOTUS) rule during an Oct. 23 hearing of U.S. Environmental Protection Agency (EPA) and Army Corps of Engineers (Corps) officials.
Goldstein reiterated ARTBA’s long-standing objection to the 2015 Obama administration rule as improperly extending federal Clean Water Act jurisdiction to roadside ditches when they are not connected to natural water bodies. The ditches are an important design feature that contributes to the nation’s public health and safety by dispersing water from roadways.
Goldstein also noted ARTBA’s support for the Trump administration’s effort to repeal the rule. He told the agencies that roadside ditches must be excluded from any rewrite of the rule.
In September, ARTBA submitted more extensive written comments on repealing the rule.
