ARTBA, as part of a coalition of more than 60 different industry associations, September 29 urged both the U.S. Environmental Protection Agency (EPA) and the U.S. Army Corps of Engineers (Corps) to withdraw a proposed rule which could greatly extend federal wetlands jurisdiction and permitting authority to cover non-navigable bodies of water, including roadside ditches.  Specifically, the groups fault EPA and the Corps for failing to properly consult with either small businesses or states and localities prior to releasing the proposal.  Further, the associations took issue with EPA and the Corps repeatedly revising and supplementing their documentation supporting the rule without giving the public adequate time to comment on new material.  The proposal is open for comment until October 20.  Read the coalition letter.
