ARTBA urged September 8 all House members to support H.R. 5078, the “Waters of the United States Regulatory Overreach Protection Act.”  The legislation, introduced by Representative Steve Southerland (R-Fla.), would prevent the U.S. Environmental Protection Agency (EPA) from finalizing a proposed rule which could extend federal wetlands permitting authority over roadside ditches to include non-navigable bodies of water, greatly expanding federal Clean Water Act (CWA) jurisdiction.  Specifically, ARTBA stated “roadside ditches are not, and should not be regulated as, traditional jurisdictional wetlands since they are an essential part of any transportation improvement project and contribute to the public health and safety of the nation by dispersing water from roadways.”  The legislation passed the House 262 to 152.  Read ARTBA’s letter.
